In today's second installment of my posts about my judge I will move on to my sentence and the reasoning behind why the judge went to the high end of the sentencing guidelines. He gave me 224 months in prison, six months of monitored home confinement, and 36 months of supervised release for a total of: 22 years and two months of the government controlling my life. He also gave me a $360,000.00 forfeiture and restitution fee.
Now there has always been a lot of talk about the maximum 20 years that my sentence can be by law, but there has been little or no talk about what the minimum sentence can be. Well, it is ZERO. That's right, the judge could have given me as little as no jail time or up to a day, a week, a year, or anywhere in between (up until the max of 20 years). Now let me relay to you why Judge Brian (Buster Brown) Cogan says that he went to the high end of my sentence, why he went so close to the borders of my life if not beyond.
Well, first this Bozo with a crystal ball finds that I am guilty of two murders. I know that I have said this before but I must say it again... The jury of my peers that are the real judges of my case said, "NOT GUILTY" six different times when it came to the six different murders that I was charged with. Not four "not guilty" and two "guilty." SIX "NOT GUILTY!"
If it was not my constitutional right to have a trial by a jury someone should have told me and the over 500 men and women who took off from their normal routines to come all the way to Brooklyn Federal Court to be questioned about being picked to serve on my jury. They should have been told that this is a futile exercise and that if their verdict does not match the judge's opinion it will not count and will be entirely disregarded.
What about the 18 gallant citizens who were chosen to serve on my jury and gave up extensive chunks of their lives to do their civic duty in the face of all kinds of hardships and frightening rumors? So according to Judge (Buster Brown) Cogan, after all they gave up, all of their honorable, hard work, and the unanimous decisions, the jurors don't count because the brilliant judge does not like the results that they've reached. I cannot believe that the founding fathers or my neighbors next-door want a political appointee to have the power to simply ignore the verdict reached by a duly sworn jury of our peers. I think that the judge and any person who believes that completely disregarding a jury's verdict is legal will be stripped of all power as soon as the people realize and understand what they are up to.
Next, the judge says that I taught Dino (Hemorrhoids) Calabro and the others about crime; that I mentored them. What a joke! Way before I knew any of them (Hemorrhoids, Richie, Anthony Basile and the rest of them) they were selling crack, robbing, and assaulting victims. According to Anthony Basile, FBI Agent Scott (The Seducer) Curtis, and our first four indictments: Hemorrhoids Calabro, Richie, and Anthony Basile already killed Officer Pagan (an armored truck guard that they stuck up) before I even knew them. They kept all of these crimes a secret from me. Next the judge talks about deterrence and the need to discourage kids from a life of crime. That's a good point but I think if Hollywood, the music industry, books, and the newspapers stop glorifying the gangster it would have a much greater affect than watching me or anyone else die in jail.
Now let's move on to the next reason that Judge Buster Brown gives for his wanting (although he denies it) to see me expire in jail. He diagnoses me as a schizophrenic. He supports this diagnosis with his extensive degrees in the medical field (bullshit) and an underlying foundation of prosecutors' rumors and acquitted conduct (charges that the jury found me innocent of). He also says that by exposing my family to Hemorrhoids Calabro and the others I was putting my family in danger and this gets back to him seeing my split personality. Well like I have said, I had no knowledge of Calabro's murdering ways. He had their crack selling, their drug use, their violence, and murders kept from me. When Hemorrhoids gave his wife a black eye he staged a car accident to explain the bruised eye to me. He went to great lengths to keep his crimes hidden from me.
Dino (Hemorrhoids) Calabro did his killing for himself; for his own personal rage, power, wealth, and ego… not for some headline making enterprise. In his mind he is the ultimate alpha male. He is much like your patron Baby Bush who starts wars for his own personal wealth, power, and ego. As a matter of fact, Hemorrhoids Calabro is more like Baby Bush than he was ever like me. You know, their way at all costs: do anything, tell any lie--as long as they come out on top.
Again, I say I never knew the true character of these rats until it was too late, but Judge you know now. Let us see what neighborhood you hide them in and how long their prison sentence is. Their sentencing should be soon. You are the judge that heard them confess the contents of their black hearts. You are the one that heard them lie and add the government's innocent targets to their own self serving deeds. And now you will be the one pronounce sentence on them. Now the world will see if you have earned the right to be called the Honorable Judge Brian Cogan. Or, will you prove to us all that you (as I say that you are) are an anti-Italian extra-prosecutor who is part of a government conspiracy to seize the rights and eventually the country from we the people in the 'guise of, "for our own good?"
Next week I will continue with Judge (Buster Brown) Cogan. I will cover my trial and I will cover Dino Saracino's 50 year sentence as soon as I get the minutes I will relay what I see to you.

Jerry-built
This post is in response to Jerry Capeci's June 12th Gangland News article:
Tommy Shots Can't Complain About The Metropolitan Detention Center Anymore
One prison compound, two Colombo family bosses.
Thomas (Tommy Shots) Gioeli, the onetime acting Colombo family boss who never missed a chance to gripe about conditions during the six years he spent at the Metropolitan Detention Center in Brooklyn, has been shipped to the same North Carolina prison complex as his crime family's official leader, the imprisoned-for-life Carmine (Junior) Persico.
For Tommy Shots, that's both good and bad. On the one hand he used to be less than an hour's drive from his family's digs in Farmingdale, L.I. He's now about 500 miles and an eight-hour-drive away, at the low security facility in Butner, North Carolina. On the plus side, Gioeli is now on the same compound as one of the Bureau of Prisons' fully equipped medical facilities. So he won't have to travel too far if eats too many candy bars and his diabetes acts up, or if he needs a special toenail clipper for a nasty one on his big toe — as has happened in the past.
Another advantage is that Tommy Shots is on the same prison complex as the 80-year-old Persico, who has been at Butner for several years as a precautionary measure following what sources say were nothing more than "normal medical issues" for inmates who manage to live into their 70s and beyond.
But it's unlikely that the onetime acting boss will ever get a chance to pay his respects to Persico, unless — either by hook, crook, or just plain happenstance — they both happen to end up in the prison hospital at the same time, for whatever reason.
That might not be a good thing for Tommy Shots. While Persico, a dyed in the wool mobster is not above murder, mayhem or anything else that might set him free, it's unlikely that he would see eye-to-eye with some of the downright embarrassing rants and raves that permeated the six-years Gioeli spent at the MDC, before, during and after his racketeering and murder trial that has him slated to be behind bars until 2024.
If they do get a chance to chat, they might want to discuss the trials, tribulations, interesting paths and current whereabouts of two longtime Colombo gangsters-turned-turncoats whose names came up frequently before and during Gioeli's trial — onetime Colombo capo Reynolds (Ren) Maragni and associate Frank (Frankie Blue Eyes) Sparaco.
As it turns out, both are currently in Florida.
Maragni, 61, is serving 45 days, the balance of a four month sentence for racketeering that he received earlier this year as a reward, despite the less than stellar cooperation he provided prosecutors at three trials, including Gioeli's. He is at a federal prison in Miami, slated to be released on June 25.
After serving nearly 20 years behind bars for several murders, Sparaco, 58, was released from a federal prison in Texas and placed into a halfway house in the Sunshine State, where he now resides. He was officially released from custody on May 12, the same day that Maragni began his short stay behind bars.
This post is just a short distraction from my follow up on Judge (Buster Brown Cogan) in answer to Jerry Capeci's interpretation of what is "embarrassing." Before I continue I will state that I am proud of my crusade for equality and I don't know how to do anything but fight when it comes to my rights and medical needs.
Now, back to Jerry-built Jerry Capeci... you see this alleged literary genius of the FBI and team America clique thinks that my raised voice for justice in the courtroom is embarrassing. For some reason this lush with an apparently Italian surname feels that Italian Americans and a few other government-chosen minorities do not deserve the equal rights that the rest of Americans receive and demand. Jerry-built thinks that asking for a toe-nail clipper is embarrassing. Well, I wonder how many diabetics who have lost toes, feet, and legs to an infected ingrown toe-nail find it embarrassing? Hey Jerry, are their missing limbs embarrassing? How about Rosa Parks? I bet you thought it was embarrassing for her to want to sit in the front of the bus. The Daily (Rag) News should be embarrassed for publishing such twaddle as my request for a toe-nail clipper and you should be embarrassed that you are so against civil rights.
Now Jerry (Jerry-built) Capeci I will tell you what is embarrassing… First, let's start with your name: "Jerry." When something is "Jerry-built" it is flimsily made; inferior. You know, much like your writing: sub-standard, garbage, junk. So why would your parents choose to name you Jerry? Fair question! Was it the act of your conception? Was it inferior? Was your father misinformed as to the procedure? Did he not understand the equipment involved? Or, was the product of their union (YOU) substandard? Are you lacking in some physical, emotional, or mental way? Well, I think you are embarrassing in all of the above. So I think the name Jerry as far as you're concerned explains itself. You are a piece of shit. Now let's examine embarrassing a little further.
Let's talk about the last time you were carried from a famous downtown watering-hole because you were so drunk you shit your pants…Well Jerry-built, news flash, that was embarrassing!!
You know what else is embarrassing? It's that in your forty or maybe even fifty years of writing about so called organized crime, in this half century of earning a handsome living off of other peoples' heartaches and misery, you never found not one innocent person whose cause you could champion? Now that is embarrassing! You know Jerry-built, not one corrupt prosecutor who framed an innocent man or two? Not one berserk FBI Agent that was out there with his rats killing people and blaming innocents for the murders? You know like Whitey Bulger and his FBI case agent Connolly, or Rossetti and his FBI handlers? All of this up there in Boston... Nothing like that goes on here in New York. Right Jerry?
Oh wait I almost forgot, how embarrassing, you did save someone from a murder charge. You and your guest writer (wink, wink) Tom (The Dirty Bird) Robbins swooped in at the eleventh hour to save that clown from a Stephen King novel, that murderous FBI Agent who slaughtered victims all over New York City, Greg (The Grim Reaper) Scarpa's partner in murder and mayhem: Liddy (The Clown) Del Vecchio. After all those years you finally found a cause you chose to bring the curtain down on... that sham of a murder trial (NYS vs. Liddy Del Vecchio). You produced notes from a book interview with Linda Schiro that did not exactly match her trial testimony. Were the notes for the book a sworn affidavit? Was it sworn testimony, or was it just jiba-jaba to make a book interesting? You know Jerry just more worthless bullshit that all of your books are jammed packed with? The witnesses told countless lies at my trial and nothing got dismissed. At any rate it seems like pretty weak evidence to get a murder case thrown out.
I smell a rat. Jerry were you working with the FBI again to get the results that they wanted? Remember, the judge said that Greg (the Grim Reaper) Scarpa Sr. was so devious that he was running the agent. Well now that we know that Frankie (Blue Eyes) Sparaco was being handled by FBI Agent Liddy Del Vecchio and he too was out killing while he was an FBI informant; what is their excuse now? These three maniacs are Satan's hit team and they are working for the FBI; and you and the justice department play a major role in protecting them. Now that is the grandest embarrassment.
So I shout: Shame on the FBI, the Justice Dept, all the prosecutors and judges that are a willing part of this... and to you. You inferior, disgraceful, shameful piece of shit; I piss on your head.

Buster Brown
To all of my followers that have been interested in my blog, now that I am going to resume posting I am going to do so in a type of installment style. Because of the limited privacy that I get in this new institution I can write in only brief spurts and not necessarily when each post is complete.
In today's post I will finally tackle a subject that I should have addressed months, if not years ago. I held off through a combination of naivety, concern for my codefendants, and fear of reprisal for my bold, but accurate description of my Judge Brian (Buster Brown) Cogan and his pro-prosecutor, anti-Italian bias that was so evident in his sentencing and rulings as well as the entire flavor of his courtroom.
This baby Bush appointed, cloaked prosecutor started his campaign to bolster the government's frame job by actually requesting my case after a truly honorable Judge (Nina Gershon) removed herself from the proceedings against me for some unknown reason. Now I don't know if his request for my case is legal or not but I have always heard that serious criminal cases are supposed to go on some rotating wheel to ensure that things are fair. Not in my case.
My judge, this WOP-hating Judas of truth, couldn't wait to lead in his chorus of lies that his fellow prosecutors and rats were about to croon for the benefit of the jury. In fact, he was positively drooling over the chance to declare, "Guilty! Death by injection!" from the bench and have his name branded in the history books for all time. Our innocence, fate, and our courageous jury allied themselves to strip Buster Brown of his macabre cravings.
We all knew that there was absolutely no evidence to support a death penalty. We all knew that this was just a government tool to terrorize Dino (Hemorrhoids) Calabro and Joe (Cave) Competiello into perjuring themselves by giving false testimony about me and my codefendant.
Here is a copy of a letter that I sent to the "Death Penalty Review Committee" in August of 2010:
To Whom It May Concern,
After two years of you manipulating a supposed unimpeachable process (Death Penalty Review) for the sole benefit of your "Criminal Informants" with utter disregard for the other defendants. Now you invite me to join in this charade. If I would have seen the total control that the United States Attorney's Office has over the death penalty review I would not have participated from the very beginning. I was lead to believe that this was a fair and impartial process not a one-sided lynching. For this and other reasons I refuse to participate in this bastardization of the death penalty review.
This letter was sent to the Death Penalty Review Committee, Judge Cogan, US Attorney Eric Holder, and to my attorney and a few others. Even though Judge (Buster Brown) Cogan did not entirely get his wish of death behind bars for me and Dino Saracino, even though we were found "Not Guilty" of all six murders and most of the other window dressing crimes that are a part of a RICO case, he is still very much in the running for us to shipped home in cardboard coffins.
I will explain the facts of our sentencing, the rulings that were made, and all of the total bias that myself, my codefendant, and most Italian Americans experience in the federal courts of the "freest" country in the world. Stay tuned for next week's posting.
